Defendant having moved, pursuant to Judiciary Law § 509 (a), to release the names and contact information for the jurors who served on the jury panel with plaintiff on June 27, 2016 to June 28, 2016,

Now, upon reading and filing the affirmations of Kevin G. Cope, Esq., dated May 9, 2018, and May 25, 2018, the notice of motion with proof of service thereof, the affirmation of Lee Alan Adlerstein, Esq, dated May 18, 2018, and the affirmation of Scott M. Schwartz, Esq., dated May 17, 2018, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted and the Commissioner of Jurors for Niagara County is directed to deliver, on before July 18, 2018, a list reflecting the names and contact information for the jurors that served on a jury with plaintiff on June 27, 2016 to June 28, 2016, under seal to the assigned Individual Assignment System judge in the underlying litigations as listed below or, in the event there is not an assigned judge, to Hon. Paula L. Feroleto, District Administrative Judge for the Eighth Judicial District, who is directed to fashion a method for the review and distribution of that information to counsel to the parties in the underlying litigations (see Baldassarre v Niagara County, Sup Ct, Niagara County, index No. E161075/2017; Baldassarre v New York State, et al., Ct Cl, claim No. 128964) to preserve the confidentiality of the jurors' information pursuant to Judiciary Law § 509(a) (see People v Chinn, 234 AD2d 1014, 1014-1015 [4th Dept 1996]).
