DECISION & ORDER ON MOTION

2018-06499

Kostas Chronis, appellant,

v Kostantine Chronis, respondent.

(Index No. 2727/16)

Motion by Kostas Chronis for leave to appeal to this Court from two orders of the Supreme Court, Queens County, dated April 26, 2018, and May 18, 2018, respectively, to stay enforcement of the orders, pending hearing and determination of the appeals, to enlarge the time to perfect the appeals, and for leave to prosecute the appeals on the original record.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the branch of the motion which is for leave to appeal from the order dated April 26, 2018, is denied; and it is further,

ORDERED that on the Court's own motion, the appeal purportedly taken as of right from the order dated April 26, 2018, is dismissed, without costs or disbursements; and it is further,

ORDERED that the branch of the motion which is for leave to appeal from the order dated May 18, 2018, is denied as unnecessary as that order is appealable as of right (see CPLR 5701); and it is further,

ORDERED that the branches of the motion which are to stay enforcement of the orders and for leave to prosecute the appeals on the original record are denied; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeals is denied as academic with respect to the appeal from the order dated April 26, 2018, and denied as premature with respect to the appeal from the order dated May 18, 2018, as the time to perfect that appeal does not expire until November 26, 2018.

MASTRO, J.P., ROMAN, HINDS-RADIX and DUFFY, JJ., concur.
