| DECISION & ORDER ON MOTION |
Joint motion by the Grievance Committee for the Ninth Judicial District and the respondent, Peter V. Spagnuolo, pursuant to 22 NYCRR 1240.8(a)(5), to impose discipline upon the respondent, on consent. By decision and order on motion of this Court dated January 4, 2018, the respondent was immediately suspended from the practice of law pursuant to Judiciary Law § 90(4)(f) and 22 NYCRR 1240.12(c)(2)(ii), as a result of his conviction of a serious crime, petit larceny, in violation of Penal Law § 155.25, a misdemeanor, and was directed, pursuant to 22 NYCRR 1240.12(c)(2)(i) and (iii), to show cause at a hearing before the Hon. Alfred J. Weiner, as Special Referee, why a final order of suspension, censure, or disbarment should not be made, based on his conviction of a serious crime. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on April 14, 1993, under the name Peter Vincent Spagnuolo.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied on the ground that discipline on consent is not available in a proceeding pursuant to 22 NYCRR 1240.12.
