Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Orange County, entered October 12, 2012, for failure to timely substitute a personal representative for the deceased appellant, Solomon Ryles.

ORDERED that the motion is granted and the appeal is dismissed (see CPLR 1021), without costs or disbursements.
