DECISION & ORDER ON MOTION

Motion by the petitioner for leave to appeal to the Court of Appeals from a decision, order and judgment of this Court dated December 27, 2017, which determined a proceeding pursuant to CPLR article 78, inter alia, in the nature of prohibition to prohibit the respondents from proceeding with an underlying criminal prosecution entitled People v Jacquet, commenced in the Supreme Court, Queens County, under Indictment No. 2319/14.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied.
