Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from the judgments of Oneida County Court, rendered October 13, 2017,
Now, upon reading and filing the affidavit of John Crosby sworn to April 19, 2018, the statement of John Crosby dated May 1, 2018, the notice of motion with proof of service thereof, the affirmation of Matthew Fanelli, Esq., dated June 27, 2018, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that John Crosby is hereby directed to file the pro se notice of appeal dated October 28, 2017 in accordance with CPL 460.10 on or before August 8, 2018, and
It is further ORDERED that the notice of appeal is deemed timely on the condition that John Crosby files the notice of appeal at the Oneida County Clerk's Office on or before August 8, 2018.
