DECISION & ORDER ON MOTION

Appeal by Natalya Goberman from an order of the Supreme Court, Queens County, dated April 1, 2016. By order to show cause dated May 11, 2018, the appellant was directed to show cause before this Court why the appeal should not be dismissed on the ground that the order was neither appealable as of right nor by permission. Motion by the appellant pursuant to CPL 460.10(6) to deem the notice of appeal from the order to be a notice of appeal from a judgment of conviction of the Supreme Court, Queens County, rendered April 1, 2016, in the above-entitled action.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is denied; and it is further,

ORDERED that the appellant's motion is granted.
