It is ordered that the motion seeking permission to appeal from the Criminal Court, County of New York decision and order (Chu, J.), dated January 26, 2018 is denied as unnecessary. Even though the caption from the underlying criminal action had been retained, the order, being civil in nature (see Real Property Law § 227-c) is appealable as of right (see People v Schonfeld, 74 NY2d 324 [1989]).
