DECISION & ORDER ON MOTION

Separate motions by the respondents on an appeal and cross appeal from an order of the Supreme Court, Kings County, dated November 24, 2015, pursuant to CPLR 1021 to dismiss the appeal for failure to appoint a personal representative for the deceased appellant-respondent, Julio Cesar Cando.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motions are denied without prejudice to renew unless on or before August 20, 2018, the appellant-respondent's former counsel submits proof to this Court, with service upon the parties to the appeal and cross appeal, that proceedings have been commenced to appoint a personal representative for the deceased appellant-respondent, Julio Cesar Cando.
