| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, for leave to appeal to this Court from an order of the Supreme Court, Nassau County, entered June 4, 2018, and to stay enforcement of the order pending hearing and determination of an appeal therefrom.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied as to so much of the order as referred for a conference the respondent's request for counsel fees of $28,000 to defend against the appellant's appeal and referred for trial the appellant's application for a downward modification of his support obligation, and that the branch of the motion which is for leave to appeal is otherwise denied as unnecessary as the remainder of the order is appealable as of right (see CPLR 5701); and it is further,
ORDERED that the motion is otherwise denied.
