DECISION & ORDER ON MOTION

Motion by the respondent on an appeal from a judgment of the Supreme Court, Orange County, dated September 12, 2017, inter alia, to be provided a copy of the forensic report, and to enlarge the time to serve and file a brief. Cross motion by the appellant for a preference in the calendaring of the appeal and to prohibit the respondent from making any further motions.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to be provided with a copy of the forensic report is granted, and the respondent will be provided one copy of the report upon request to the Clerk of this Court or her designee; and it is further,

ORDERED that disclosure and dissemination of the report shall be in accordance with the affidavit regarding access to forensic reports to be executed by the respondent when he is provided with a copy of the report; and it is further,

ORDERED that the branch of the motion which is to enlarge the respondent's time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until September 4, 2018, and the respondent's brief shall be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied; and it is further,

ORDERED that the cross motion is denied.
