170 W. 85th St. HDFC v Cantave, Zulema & Marie It is Ordered that motion & cross motion are consolidated for disposition. It is further Ordered that tenants-respondents' motion seeking to dismiss appeal for failure to perfect its appeal pursuant to this Court's Order, dated Mar. 20, 2018 is denied.
It is also further Ordered that the petitioner-appellant cross motion seeking to enlarge the time to perfect its appeal is granted. Petitioner-appellant shall perfect its appeal for the December 2018 term - the filing deadline for which is October 9, 2018. No further enlargements of time shall be granted. In the event of petitioner-appellant's failure to comply with this Court's order, tenants-respondents may move on five days notice for an order dismissing the appeal.
