Petitioner having moved to vacate dismissal of the proceeding (denominated as a motion seeking an extension of time to file a brief) in this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Cayuga on January 23, 2018,
Now, upon reading and filing the affidavit of Echo Westley Dixon sworn to June 18, 2018, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to vacate dismissal of the proceeding is granted to the extent the first ordering paragraph of the order of this Court entered April 9, 2018, is hereby amended by deleting the date June 9, 2018, and inserting in its place the date August 27, 2018, and
It is further ORDERED that the second ordering paragraph of the order of this Court entered April 9, 2018, is hereby amended by deleting the date July 16, 2018, and inserting in its place the date October 1, 2018.
