DECISION & ORDER ON MOTION

The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on July 27, 2005, under the name Nancy Patricia Enoksen. By opinion and order dated February 14, 2018, this Court disbarred the respondent, effective immediately, based upon the allegations of professional misconduct set forth in a petition dated December 16, 2014, in a disciplinary proceeding instituted pursuant to 22 NYCRR 1240.8 by the Grievance Committee for the Tenth Judicial District under Appellate Division Docket No. 2017-08203, and discontinued as academic a disciplinary proceeding under Appellate Division Docket No. 2014-07821. The Grievance Committee has advised the Court that the respondent was convicted of grand larceny in the second degree, in violation of Penal Law § 155.40(1), a class C felony, on January 29, 2018, upon a jury verdict, in the County Court, Nassau County (Howard Sturim, J.), under Indictment No. 00911N-2016.

Now, on the Court's own motion,

ORDERED that the opinion and order of this Court dated February 14, 2018, is recalled and vacated; and it is further,

ORDERED that the disciplinary proceeding instituted pursuant to 22 NYCRR 1240.8 by the Grievance Committee for the Tenth Judicial District under Appellate Division Docket No. 2017-08203 is discontinued, in light of the automatic disbarment of Nancy P. Enoksen, admitted as Nancy Patricia Enoksen, on January 29, 2018, pursuant to Judiciary Law § 90(4)(b).
