An Article 78 proceeding to review a determination of respondent having been transferred to this Court, pursuant to CPLR 7804(g), by an order of the Supreme Court, New York County, entered on or about June 12, 2017, And respondent East Midtown Plaza Housing Company, Inc., having moved to dismiss the aforesaid proceeding for failure to timely prosecute (M-3034), And petitioner having cross moved for an enlargement of time to perfect the proceeding (M-3198), Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon, It is ordered that respondent's motion to dismiss the proceeding is granted unless the proceeding is perfected for December 2018 Term (M-3034), And it is further ordered that petitioner's motion to enlarge is granted to the extent of enlarging the time to perfect the proceeding to the December 2018 Term (M-3198).
