ORDERED that the decision and order on motion of this Court dated August 16, 2018, is recalled and vacated and the following decision and order on motion is substituted therefor:
Motion by the respondent pursuant to CPL 460.20, for a certificate granting leave to appeal to the Court of Appeals from a decision and order of this Court dated May 9, 2018, which modified a judgment of the Supreme Court, Nassau County, rendered March 9, 2016.
