Now, upon reading and filing the affirmation of Alyssa Truelove, Esq., dated August 3, 2018, the notice of motion with proof of service thereof, and there being no opposition thereto,
It is hereby ORDERED that the notice of appeal served on October 3, 2008 is hereby deemed timely served pursuant to CPL 460.10 (6), and
It is further ORDERED that the motion is granted, and the appeal is dismissed.
