Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Kings County, dated May 3, 2017, for failure to timely perfect and to dismiss an appeal from an order of the same court dated May 3, 2016, on the ground that the right of direct appeal from the order terminated upon entry of the judgment.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied without prejudice to renew upon proper papers, including proof of service upon the appellant's counsel at the appellant's counsel's proper address.
