Abbatoy, Jr., Esq., dated August 30, 2018, the affidavit of Richelle L. Barr sworn to August 30, 2018, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motions are granted and the petition is dismissed (see CPLR 506 [b] [1]; 7804 [b]; Matter of Nolan v Lungen, 61 NY2d 788, 790 [1984]), and

It is further ORDERED that the cross motion is dismissed.
