DECISION & ORDER ON MOTION

Parker Forest Hill, L.P., Respondent, v Ruben Zizva, Appellant, et al., Undertenants.

Motion by appellant on an appeal from an order of the Civil Court of the City of New York, Queens County, entered March 7, 2018, to modify a provision of a stay granted by decision and order on motion of this court dated July 6, 2018, requiring appellant to deposit the sum of $42,347.70 into court, to instead allow appellant to pay that sum directly to respondent.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted and appellant is directed to pay to respondent within 10 days from the date of this decision and order on motion the sum of $42,347.70 and to continue to comply with the other conditions of the decision and order on motion dated July 6, 2018; and it is further,

ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay, on three days' notice.
