| DECISION & ORDER ON MOTION |
Motion by the respondent, inter alia, for leave to serve and file a supplemental brief on an appeal from a judgment of the Supreme Court, Nassau County, rendered January 27, 2017, responding to the appellant's argument regarding Carpenter v United States (__ US __, 138 S Ct 2206).
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is for leave to serve and file a supplemental brief is granted and on or before October 19, 2018, the respondent may serve and file a supplemental brief responding to the appellant's argument regarding Carpenter v United States (__ US __, 138 S Ct 2206); and it is further,
ORDERED that the motion is otherwise denied.
