It is Ordered that motion & cross-motion are consolidated for disposition.
It is further Ordered that plaintiff-appellant's motion seeking an enlargement of time to perfect appeal is granted. Appellant shall perfect his appeal by no later than Jan. 2019 term - filing deadline for which is Nov. 7, 2018.
It is also further Ordered that defendant-respondent's cross-motion seeking to deny the enlargement of time to perfect the appeal and to dismiss the appeal is denied.
No further enlargement of time shall be granted. In the event the plaintiff-appellant fails to comply with the foregoing condition, defendant-respondent may move on five days notice for an order dismissing the appeal.
