Motion by the respondent to dismiss, for failure to prosecute, an appeal from a judgment of the County Court, Westchester County, rendered September 21, 2005, which was deemed abandoned pursuant to former 22 NYCRR 670.8(f).

ORDERED that the motion is granted and the appeal is dismissed.
