DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Ilir Ahmeti, Appellant.

Motion by appellant for summary reversal of a judgment of conviction of the Criminal Court of the City of New York, Queens County, rendered November 19, 2014, on the ground that the transcript of the trial proceedings held on September 17, 2014 is unavailable. By decision and order on motion of this court dated September 5, 2017, the matter was remitted to the Criminal Court for a hearing to determine if the transcript of the trial proceedings held on September 17, 2014 could be reconstructed and the motion was held in abeyance in the interim. The Criminal Court has now filed its report.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, and upon the Criminal Court's report, it is

ORDERED that the motion is denied.
