(Index No. 34155/2017)

DECISION & ORDER ON MOTION

Motion by the appellant to enlarge the time to perfect appeals from three orders of the Supreme Court, Rockland County, two dated December 21, 2017, and one dated December 22, 2017.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion, the appeal from the order dated December 22, 2017, is dismissed, without costs or disbursements, on the ground that no appeal lies as of right from an order that is not the result of a motion made on notice and leave to appeal has not been granted (see CPLR 5701); and it is further,

ORDERED that the motion is granted to the extent that the appellant's time to perfect the appeals from the orders dated December 21, 2017, is enlarged until November 21, 2018, and the record or appendix on those appeals and the appellant's brief shall be served and filed on or before that date, and the motion is otherwise denied as academic.

BALKIN, J.P., CHAMBERS, COHEN and MILLER, JJ., concur.
