DECISION & ORDER ON MOTION

Appeals by Timothy R. from two orders of the Family Court, Nassau County, dated June 27, 2017, and September 14, 2017, respectively. By order on certification of this Court dated July 10, 2018, counsel was assigned to respond to the appeals and directed to contact the respondent and determine the respondent's interest in responding to the appeals. By letter dated August 29, 2018, assigned counsel notified the Court that she has been unable to contact the respondent. By decision and order on motion of this Court dated September 14, 2018, on the Court's own motion, the respondent's assigned counsel was relieved of the assignment. By letter dated October 15, 2018, this Court was advised that the respondent wanted assigned counsel to respond to the appeal.

Now, on the Court's own motion, it is

ORDERED that the decision and order on motion of this Court dated September 14, 2018, is recalled and vacated, and assigned counsel for the respondent is reinstated; and it is further,

ORDERED that pursuant to § 670.3(b)(2) of the rules of this Court (see 22 NYCRR 670.3[b][2]), the respondent's time to serve and file a brief is enlarged until November 16, 2018, and the respondent's brief shall be served and filed on or before that date.
