DECISION & ORDER ON MOTION

Appeal by Delmar Moore from an order of the Family Court, Westchester County, dated December 11, 2017. By scheduling order dated September 12, 2018, the appellant's time to perfect the appeal was enlarged until October 9, 2018. The appellant has failed to perfect the appeal.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to timely perfect in accordance with the rules (see 22 NYCRR 670.3[b][2]) and prior order of the Court.
