An appeal having been taken from the judgment of the Supreme Court, New York County, rendered on or about October 16, 2015, And an order of this Court having been entered on May 26, 2016 (M-1630), granting defendant leave to prosecute his appeal as a poor person, and assigning Richard M. Greenberg, Esq., predecessor to Chief counsel to Christina Swarns, Esq., The Office of Appellate Litigation, as counsel to prosecute the appeal, And an order of this Court having been entered on August 23, 2018 (M-3019), denying defendant-appellant's motion for the appointment of a private investigator, without prejudice to making such an application in Supreme Court, New York County, And defendant-appellant having moved to renew the motion to appoint a private investigator, and to relieve assigned counsel on the appeal and to have a new counsel assigned to prosecute same,Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied.
