Counsel for appellant having moved to consolidate the oral arguments for the appeals taken from the judgment of Chautauqua County Court rendered December 3, 2001 (KA 02-00941), the order of Chautauqua County Court dated August 12, 2016 (KA 16-01536), and the order of Chautauqua County Court dated June 14, 2016 (KA 18-01708), and for other relief,

Now, upon reading and filing the affirmation of Thomas Theophilos, Esq., dated September 27, 2018, the notice of smotion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the appeal from the judgment of Chautauqua County Court rendered December 3, 2001 is removed from the calendar for the term of this Court commencing on January 7, 2019, and

It is further ORDERED that the appeal shall be added to the calendar for the term of this Court commencing on February 19, 2019, and

It is further ORDERED that the motion is otherwise denied.
