2018-12012 255 Butler Associates, LLC, appellant, v 255 Butler, LLC, et al., respondents. (Index No. 511560/15)
| DECISION & ORDER ON MOTION |
Motion by 255 Butler Associates, LLC, for leave to appeal to this Court from so much of an order of the Supreme Court, Kings County, dated September 26, 2018, as prohibited the videotaping the depositions of the respondents other than Ariel Akkad, and to stay enforcement of so much of that portion of the order as well as the portion of the order which, in effect, denied their motion to prohibit the videotaping the depositions of Ariel Akkad, pending hearing and determination of an appeal from the order.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that on the Court's own motion, the appeal purportedly taken as of right from so much of the order as prohibited the videotaping the depositions of the respondents other than Ariel Akkad is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion is otherwise denied.
LEVENTHAL, J.P., MILLER, DUFFY and BRATHWAITE NELSON, JJ., concur.
