DECISION & ORDER ON MOTION

Motion by the attorney for the child to dismiss an appeal from an order of the Family Court, Suffolk County, dated March 23, 2018, on the grounds that the appeal has been rendered academic, that the transcript is incomplete, and that the appellant's claim for monetary damages is not properly before the Court, or, in the alternative, to extend the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to dismiss the appeal is denied on condition that on or before December 5, 2018, the appellant file with this Court the transcript of the proceedings which occurred on May 22, 2017, July 27, 2017, September 7, 2017, and December 7, 2017; and it is further,

ORDERED that the branch of the motion which is to extend the attorney for the child's time to serve and file a brief is granted, the attorney for the child's time to serve and file a brief is extended until January 4, 2019, and the respondent's brief shall be served and filed on or before that date.
