| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Suffolk County, dated September 19, 2017, and to vacate a stay granted by a decision and order on motion of this Court dated January 24, 2018, as amended March 21, 2018, and June 19, 2018.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal is denied as unnecessary as the appeal was deemed dismissed pursuant to 22 NYCRR 1250.10(a); and it is further,
ORDERED that the branch of the motion which is to vacate the stay is granted and the stay granted by the decision and order on motion of this Court dated January 24, 2018, as amended March 21, 2018, and June 19, 2018, is vacated forthwith.
