| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Suffolk County, dated April 18, 2018, and an order of the same court, dated March 12, 2018, with respect to all of the underlying actions except the action under Index No. 28233/13, on the ground that the appeal was not properly taken as to those other actions. Cross motion by the appellant to declare that it was not required to pay filing fees for each action pending in the Supreme Court in connection with the appeal from the judgment or, in the alternative, for leave to re-file and re-upload separate notices of appeal for each action pending in the Supreme Court in connection with the appeal from the judgment and pay additional filing fees, nunc pro tunc to the filing of the original notice of appeal.
Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is
ORDERED that the motion and the cross motion are denied.
