An appeal having been taken to this Court by defendant from the judgment of the Supreme Court, New York County, rendered on or about March 7, 2013, And said appeal not having been brought on for hearing pursuant to the provisions of the Rules of Practice of the Appellate Division, First Department, And a calendar call having been held by the Clerk of the Court on May 31, 2018, pursuant to Rule 600.12(c) of said Rules of Practice, and counsel for appellant having submitted an affirmation seeking an enlargement of time in which to perfect the appeal, And the parties herein having subsequently entered into a stipulation withdrawing the aforesaid appeal, Now, upon reading and filing the papers herein, including the aforesaid stipulation, and due deliberation having been had thereon, It is ordered that the appeal is deemed withdrawn in accordance with the aforesaid stipulation. The order of this Court entered on July 5, 2018 (M-3576) is hereby recalled and vacated.ENTERED: November 29, 2018
