| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of an order of the Supreme Court, Suffolk County, dated September 27, 2018, and to stay a hearing on the issue of damages on the counterclaim in the above-entitled action, pending hearing and determination of an appeal from the order, and to enlarge the record to include the transcript of the proceedings which occurred on August 30, 2018, held in connection with the motion that was determined by the order dated September 27, 2018.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay enforcement of the order dated September 27, 2018, and the hearing on the issue of damages is denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the record to include the transcript of the proceedings which occurred on August 30, 2018, is denied as unnecessary.
