DECISION & ORDER ON MOTION

Motion by the appellant to extend the time to comply with a decision and order on motion of this Court dated July 31, 2018, on an appeal from an order of the Supreme Court, Suffolk County, dated July 18, 2017.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and on or before December 20, 2018, the appellant shall remove pages A46 and A94 from the copies of the appellant's appendix filed with the Clerk of the Court, replace the table of contents of the copies of the appellant's appendix filed with the Clerk of the Court with a table of contents which lists and briefly describes the exhibits annexed to the affirmation in opposition and the reply affirmation, and serve and file a supplemental appellant's appendix containing the documents annexed as Exhibits D, F, G, and H to the motion papers which were filed in connection with the motion which was determined by the decision and order on motion of this Court dated July 31, 2018; and it is further,

ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is extended until January 22, 2019, and the respondent's brief shall be served and filed on or before that date.
