DECISION & ORDER ON MOTION

Motion by the petitioner-respondent to dismiss an appeal from an order of the Family Court, Suffolk County, dated August 13, 2018, on the ground that no appeal lies from a nondispositional order in a proceeding pursuant to Family Court Act § 10.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied.
