Petitioner having moved for an extension of time to file and serve a brief on this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on October 1, 2018, and respondent New York State Division of Human Rights having applied for an extension of time to file and serve a respondent's brief,
Now, upon reading and filing the affirmation of Michael J. Balestra, Esq., dated November 20, 2018, the notice of motion with proof of service thereof, and due deliberation having been had thereon, and the statement of Toni Ann Hollifield, Esq., dated November 28, 2018,
It is hereby ORDERED that petitioner's motion is granted on the condition that petitioner's brief is filed and served on or before December 14, 2018, and the Clerk is directed to accept the brief for filing, and
It is further ORDERED that respondent New York State Division of Human Rights application is granted on the condition that its brief is filed and served on or before January 18, 2019, and the Clerk is directed to accept the brief for filing.
