Appeal from an order of the Civil Court of the City of New York, Kings County, entered March 28, 2018. A review of the record on appeal indicates that there may be an issue as to whether appellant Willie Lilley is an adult incapable of defending his own rights.
On the court's own motion, it is
ORDERED that the parties show cause before this court whether appellant Willie Lilley is an adult incapable of defending his own rights and, thus, is a person in need of a guardian ad litem (see CPLR 1201), by filing an affidavit or affirmation on that issue with the Clerk of this court on or before December 20, 2018; and it is further,
ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this decision and order on motion on respondent and on appellant's attorney by regular mail.
Appellant's counsel is directed to include in his responding papers an affidavit on personal knowledge from appellant Willie Lilley and documentary proof of his authorization to represent appellant, or show cause why these papers can not be provided.
