DECISION & ORDER ON MOTION

Artur Kotarba, Respondent, v Andrea Bobrow, Appellant.

Motion by respondent for a preference in the calendaring of an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered April 25, 2017. Separate motion by respondent to dismiss the appeal for lack of prosecution. Separate motion by appellant for an enlargement of time to perfect the appeal.

Upon the papers filed in support of respondent's motions and appellant's motion, and the papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that respondent's motions and appellant's motion are consolidated for purposes of disposition; and it is further,

ORDERED that respondent's motions are denied; and it is further,

ORDERED that appellant's motion is granted and the time to perfect the appeal is enlarged to February 4, 2019; and it is further,

ORDERED that in the event the appeal is not perfected on or before February 4, 2019, the court, on its own motion, may dismiss the appeal, or respondent may move to dismiss the appeal, on three days' notice, and may serve such application in person.
