Columbus Manor LLC -v Turnbull, Linda, et al It is Ordered that motion & cross motion are consolidated for disposition. It is further Ordered that respondent-respondent's motion seeking to dismiss appeal is denied.
It is also further Ordered that petitioner-appellant's cross motion is granted. The notice of appeal, which was timely filed, is deemed timely served pursuant to CPLR 5520(a). It is further ordered that the notice of appeal from the order of Civil Court, New York County, dated August 6, 2018, is deemed to be a premature notice of appeal from an amended order of the same court, dated August 10, 2018 (CPLR 5520[c]).
