Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Erie County Court, rendered April 5, 2018,

Now, upon reading and filing the affirmation of Walter L. Rooth, III, Esq. dated August 28, 2018, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the notice of appeal dated August 28, 2018 which inaccurately lists the conviction crime shall be treated as valid as to the judgment of Erie County Court, rendered April 5, 2018 for Indictment 2017-01738 pursuant to CPL 460.10(6), and

It is further ORDERED that the motion is dismissed as unnecessary.
