| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the record on an appeal from an order of the Supreme Court, Kings County, dated February 5, 2018, to include the 32 documents itemized in Exhibit D annexed to the affirmation of Nathaniel Z. Marmur filed in support of the appellant's motion or for the Court to take judicial notice of those documents, and to extend the time to perfect the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to enlarge the record is denied as unnecessary as the subject documents are part of the record; and it is further,
ORDERED that the branch of the motion which is to extend the time to perfect the appeal is granted, the appellant's time to perfect the appeal is extended until January 14, 2019, and the record or appendix on the appeal and the appellant's brief shall be served and filed on or before that date; and it is further,
ORDERED that the motion is otherwise denied.
