| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Nassau County, entered August 14, 2017, for failure to comply with a decision and order on motion of this Court dated September 10, 2018, or, in the alternative, to extend the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal is denied on condition that on or before December 28, 2018, the appellant serve and file a supplemental record containing the judgment; and it is further,
ORDERED that no further extension of time shall be granted; and it is further,
ORDERED that the branch of the motion which is to extend the time to serve and file a brief is granted, the respondent's time to serve and file a brief is extended until January 28, 2019, and the respondent's brief shall be served and filed on or before that date.
