Petitioner-appellant having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Erie County, entered in the Office of the Clerk of said Court on May 9, 2018, and for an extension of time to perfect,

Now, upon reading and filing the affidavit of Pamela Robinson, sworn to October 22, 2018, the affirmation of Charles J. Greenberg, Esq., dated November 19, 2018, the notice of motion with proof of service thereof, and the affirmation of Dominic Paul Candino, Esq., dated November 26, 2018, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks permission to proceed as a poor person and the assignment of counsel is granted, and

It is further ORDERED that Charles J. Greenberg, Esq., 3840 East Robinson Road, Suite 318, Amherst, New York 14228-2001, is hereby assigned as counsel to conduct the appeal, and

It is further ORDERED that the Clerk of the Family Court, Erie County, provide Charles J. Greenberg, Esq., with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings had and filed in said Clerk's Office upon which the appeal is based, and

It is further ORDERED that the record and briefs are to be filed and served within 60 days of the filing of the transcripts with the Erie County Family Court Clerk's Office, and

It is further ORDERED that the motion insofar as it seeks an extension of time to perfect is dismissed as unnecessary.
