| DECISION & ORDER ON MOTION Motion for Poor Person Relief and to Assign Counsel |
Motion by the appellant (1) to deem a notice of an appeal from a judgment of the Supreme Court, Kings County, rendered May 31, 2016, under Indictment No. 3365/14, to reflect that the appeal is also from a judgment of the same court, also rendered May 31, 2016, under Indictment No. 7929/14, (2), in effect, to amend a decision and order on motion of this Court dated December 12, 2017, which granted poor person relief and the assignment of counsel with respect to the appeal from the judgment rendered under Indictment No. 3365/14 to reflect that poor person relief and the assignment of counsel are also granted with respect to the appeal from the judgment rendered under Indictment No. 7929/14, and (3) to consolidate the appeals, or, (4) in the alternative, to extend the time to serve and file a notice of appeal concerning the judgment rendered under Indictment No. 7929/14.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branches of the motion which are to deem the notice of appeal to also be from the judgment rendered under Indictment No. 7929/14, in effect, to amend the decision and order on motion of this Court dated December 12, 2017, to reflect that poor person relief and the assignment of counsel are also granted with respect to the appeal from the judgment rendered under Indictment No. 7929/14, and to consolidate the appeals are granted; and it is further,
ORDERED that the motion is otherwise denied.
