DECISION & ORDER ON MOTION

Motion by the appellant-respondent to stay enforcement of stated portions of a judgment of the Supreme Court, Putnam County, dated November 20, 2017, pending hearing and determination of an appeal and a cross appeal from the judgment, for a preference in the calendaring of the appeal and cross appeal, and to extend the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to extend the time to perfect the appeal is granted, the appellant-respondent's time to perfect the appeal is extended until January 7, 2019, and the joint record or appendix (see 22 NYCRR 1250.9[f][1][ii]) and the appellant-respondent's brief shall be served and filed on or before that date; and it is further,

ORDERED that the respondent-appellant shall serve and file the answering brief, including the points of argument on the cross appeal, in accordance with the rules of this Court (see 22 NYCRR 1250.9[f][1][iv]); and it is further,

ORDERED that the motion is otherwise denied.
