It is Ordered that the motion of the claimant-respondent seeking the dismissal of the instant appeal is denied. The defendant-appellant shall perfect his appeal by no later than the April 2019 term the filing deadline for which is February 5,2019. Respondent's briefs are to be filed by February 27, 2019; reply briefs, if any, are to be filed by March 7, 2019. In the even that the defendant-appellant fails to comply with the foregoing condition, the claimant-respondent may move, on five days notice, for an order dismissing the appeal.
