| DECISION & ORDER ON MOTION |
Motion by the plaintiff-respondent on appeals from two orders of the Supreme Court, Kings County, dated January 30, 2017, and January 17, 2017, respectively, to dismiss the appeals by the appellant Jude Ozuzu for failure to timely perfect. Application by the appellants to extend the time to perfect the appeals.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied as unnecessary as the appeals have been deemed dismissed pursuant to 22 NYCRR 1250.10(a); and it is further,
ORDERED that the application is denied without prejudice to the appellants making a motion pursuant to 22 NYCRR 1250.10(c) to vacate the dismissal of the appeals.
