DECISION & ORDER ON MOTION

Motion by the plaintiff-respondent to dismiss appeals from two orders of the Supreme Court, Kings County, both dated July 14, 2017, on the ground that the record is inadequate or, in the alternative, to extend the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to dismiss the appeals is denied on condition that on or before January 28, 2019, the appellant serve and file a supplemental record containing the plaintiff-respondent's opposition to the cross motion, the plaintiff-respondent's reply in connection with its motion for summary judgment, and the appellant's reply on the cross motion, which were considered by the Supreme Court, Kings County, in determining the motion and cross motion that resulted in the two orders dated July 14, 2017; and it is further,

ORDERED that the branch of the motion which is to extend the plaintiff-respondent's time to serve and file a brief is granted, the plaintiff-respondent's time to serve and file a brief is extended until February 27, 2019, and the plaintiff-respondent's brief shall be served and filed on or before that date.
